Terms of Service
Last updated: [LAST UPDATED DATE]
These Terms govern your use of OnPoint, provided by [COMPANY], [REGISTRATION NUMBER], established in [COUNTRY], with contact address [CONTACT EMAIL].
1. About the service
OnPoint is a subscription-based clinical support tool for acupuncture and manual techniques, including acupuncture, gua sha, tuina, cupping and moxibustion. Features may include structured intake, pattern-support, point references, classical learning material and treatment suggestions.
2. Formation of agreement
You enter into an agreement with [COMPANY] when you create an account, accept these Terms or purchase a subscription, whichever occurs first. You must be at least [MINIMUM AGE] and legally able to contract. You must provide accurate information and keep credentials confidential.
3. Subscriptions and Stripe payments
Prices, billing intervals, taxes and plan features are shown before purchase. Subscriptions renew automatically until cancelled unless stated otherwise. Stripe is our payment processor; we do not store card numbers. You authorise recurring charges through Stripe. Failed payments may result in suspended access.
Student subscriptions
Student pricing requires current eligibility and verification using a school-issued email address and, if requested, additional evidence. We may review eligibility and move an ineligible account to the standard plan after notice.
4. Cancellation
You may cancel through your account or by contacting [CONTACT EMAIL]. Cancellation stops future renewal; access continues until the end of the paid billing period unless law requires otherwise. Fees already paid are handled under the Refund Policy. If you cancel a founder plan, its protected founder price is forfeited and cannot be restored if you later resubscribe.
5. Right of withdrawal
Consumers may have a statutory withdrawal period. The period, start date and effect of requesting immediate digital performance vary by country. See our Refund Policy and complete [WITHDRAWAL-PERIOD RULES] before launch. Statutory consumer rights vary by country and are not limited by these Terms.
6. Acceptable use
- Do not share accounts, bypass access controls, scrape content or reverse engineer the service except where law expressly permits.
- Do not upload unlawful, infringing, malicious or patient-identifying content.
- Do not use OnPoint to provide unsafe, deceptive or unauthorised care.
- Do not interfere with security, availability or other users.
We may suspend or terminate access for material violations, security risks or legal requirements, with notice where reasonably possible.
7. Medical and professional responsibility
OnPoint provides information and decision support only. It is not a diagnosis, prescription, emergency service or substitute for professional judgement. AI-generated or reference content may be incomplete or incorrect and must be independently assessed. You remain solely responsible for patient assessment, informed consent, treatment decisions, records and outcomes, and for holding all licences, qualifications and insurance required within your scope of practice and jurisdiction. In an emergency, use local emergency services.
8. Intellectual property
[COMPANY] and its licensors retain rights in the service, software, design and original content. You receive a limited, personal, non-transferable right to use OnPoint during an active subscription. Public-domain source materials remain subject to their applicable status and attribution.
9. Availability and liability
We aim for reliable service but do not guarantee uninterrupted availability or error-free results. To the maximum extent permitted by [GOVERNING LAW], [COMPANY] is not liable for indirect, consequential or lost-profit damages. Our aggregate liability is limited to [LIABILITY CAP], except where liability cannot legally be excluded or limited, including applicable mandatory consumer rights.
10. Changes and termination
We may change features, prices or these Terms. Material changes will be notified at least [NOTICE PERIOD] in advance where required. Continued use after the effective date constitutes acceptance where legally valid. You may stop using the service and cancel if you do not accept a change.
11. Governing law and disputes
These Terms are governed by [GOVERNING LAW], and disputes are subject to [COURTS / DISPUTE FORUM], without depriving consumers of mandatory protections available in their country of residence. Contact us first so we can try to resolve a concern.
